Notice of Hearing

The Director of the Department of Insurance has scheduled a public hearing as required by Neb.Rev.Stat. §84-901 to §84-909 for the proposed amendment of Title 210, Nebraska Administrative Code, Chapter 34, Title Insurance. The proposed amendments delete the previous version of the regulation and add new language to address the title insurer's on-site review of the title insurance agent's business as required pursuant to Neb. Rev. Stat. §44-1993 and records required to be maintained by the title insurance agent. The amendments also provide the standards for the annual CPA audit as required pursuant to Neb. Rev. Stat. §44-19,116. There is no fiscal impact to the Department of Insurance or political subdivisions. There may be a fiscal impact on the regulated public. A hearing was held on August 18, 2003 to address the proposed amendments. As a result of testimony received at the August 18, 2003 hearing, the Department made changes to the proposed amendments and, therefore, will hold a second hearing in which to accept public comment at 10:00 a.m. on the 20th day of October, 2003.

Copies of Chapter 34 and the Fiscal Impact Statement are available upon request at a cost of $3.50 each from the Department of Insurance, 941 "O" Street, Suite 400, Lincoln, NE 68508. Copies of Chapter 34 and the Fiscal Impact Statement are available for inspection at the aforementioned address, as well as the Office of the Secretary of State, State Capitol Building, Room 343, Lincoln, NE 68509, and through the Department's web site at www.nol.org/home/ndoi. All persons interested in presenting oral or written views on the proposed amendment of Chapter 34 will be granted an opportunity at a hearing to be held before the Director of Insurance, State of Nebraska, beginning at 10:00 a.m. the 20th day of October, 2003, and will continue until concluded. Said hearing will be held in the 5th Floor Conference Room of the Terminal Building at 941 "O" Street, Lincoln, NE 68508.

Reasonable accommodations will be provided to person with disabilities upon advanced request. The hearing will be transcribed at the request of any party with the expense of the transcription charged to the requesting party.
