NOTICE

The Director of the Department of Insurance has scheduled a public hearing as required by Neb.Rev.Stat. §84-901 to §84-909 for the proposed amendments to Title 210, Nebraska Administrative Code, Chapter 73, Exempt Commercial Policyholders Regulation. The proposed rule implements the amendment to Neb.Rev.Stat. §§ 44-7515 made by LB 1139, passed in the 2002 session, that requires the director to adopt regulations that require insurers to inform exempt commercial policyholders at the earliest practical date, but no later than thirty days after the inception of coverage, that policy forms applying to them have not been approved by the director. Second, the amendments also reduce the threshold at which commercial property and casualty policyholders qualify for exempt commercial policyholder status for purposes of rate regulation from $100,000 of annual premium to $75,000. Copies of Chapter 73 are available upon request at a cost of $4.50 each from the Department of Insurance, 941 "O" Street, Suite 400, Lincoln, NE 68508. Copies of Chapter 73 are available for inspection at the aforementioned address, as well as the Office of the Secretary of State, State Capitol Building, Room 343, Lincoln, NE 68509, and through the Department's web site at www.nol.org/home/doi. All persons interested in presenting oral or written views on the proposed adoption of Chapter 73 will be granted an opportunity at a hearing to be held before the Director of Insurance, State of Nebraska, beginning at 10:00 a.m. on the seventeenth day of December 2002, and will continue until concluded. Said hearing will be held in the 5th Floor Conference Room of the Terminal Building at 941 "O" Street, Lincoln, NE 68508.
