Misleading Marketing and Advertising Seminar 

Since the age of technology and the harvesting of personal data, most people know what to look out for when it comes to scammers. For those wanting to learn more, join the Nebraska Department of Insurance for a presentation about the signs of this marketing and how lawyers can combat these issues. “As regulators of the insurance industry, it is our duty to protect current and potential policyholders from harm, especially in situations where vulnerable markets are targeted. ” On Friday, May 6, members of NDOI’s Legal Counsel - Michael Anderson and Martin Swanson - presented and shared real-life examples of these scams. Michael Anderson previously served as Assistant Attorney General in Missouri’s Medicaid Fraud Control Unit. Martin Swanson chairs the Improper Marketing of Health Plans working group at the National Association of Insurance Commissioners.

Regulatory and Market Trends in Health Insurance

From Covid-19 testing to the No Surprises Act, health insurance must change with the world. For those wanting to learn more about transparency in coverage and what’s next in healthcare, please join the Nebraska Department of Insurance (NDOI) and Blue Cross and Blue Shield of Nebraska for a presentation focused on the changing needs of Policyholder. On Tuesday, June 14, NDOI’s Life and Health Policy Administrator Laura Arp and Blue Cross and Blue Shield of Nebraska Assistant General Counsel and Corporate Compliance Officer Cameron Arch for a joint discussion on health insurance. Laura Arp manages NDOI implementation of federal and state health insurance laws and serves on the National Association of Insurance Commissioners working groups and task forces for pharmacy benefit managers (vice-chair), accident and sickness minimum standards (co-chair), health innovations (co-vice chair), MHPAEA and ERISA. Cameron Arch leads the company’s compliance with federal, state, and local rules, regulations, and requirements.

Insurance Fraud: Issues and Case Studies 

With a growing insurance industry across the United States, the opportunity to commit insurance fraud increases every day. For those wanting to learn more about how to recognize and prevent insurance fraud, please join the Nebraska Department of Insurance (NDOI) for a presentation filled with case studies and learn about the tools the Department utilizes to fight insurance fraud.On Thursday, July 21, members of NDOI’s Legal Counsel and Fraud Prevention Division will present and share case studies of fraud. Michael Anderson previously served as an Assistant Attorney General with the State of Missouri in the Medicaid Fraud Control Unit. Kimberly Church, the head of NDOI’s Fraud Division and a certified law enforcement officer. Currently, Kimberly acts as Treasurer of the Nebraska Crime Stoppers.

Big Data: A New Frontier 

Data, data everywhere and all of it of use. Big Data, a term sweeping the nation, used to describe data sources that are fast-changing, large in both size and breadth of information, and come from sources other than surveys. So, how does Big Data play in the insurance industry? On Thursday, August 25, NDOI's Legal Counsel Megan VanAusdall will break down the character Big Data plays in the insurance industry. Previously, Megan served as Legal Counsel with the Missouri Department of Insurance and as an Assistant Public Defender in Dunklin County, Missouri.

Solvency Regulation and Insolvency Procedures 

Have you ever wondered what happens when an insurance company runs out of money and can’t pay claims? Learn about how insurance regulators monitor companies’ solvency and the statutory procedures used to rehabilitate or liquidate financially troubled companies. On Friday, September 30, NDOI’s Life and Health Policy Administrator Laura Arp broke down how solvency regulations and procedures help protect the policyholder. Laura joined NDOI in 2012 and has served as counsel on a broad range of issues and lines of insurance. She currently serves as Life and Health Administrator and is Counsel for the Medical Malpractice Excess Liability Fund.

Insights on Form B, C, and D Filings 

Do you have questions about Form Filings B, C, and D? Would you like to hear from the regulator's perspective on these filings?

On Tuesday, Febraury 28th, NDOI Attorney Michael Anderson will be joined by Holding Company Analyst, Chris Amory, and Assistant Chief Examiner of the Holding Company area, Jill Gleason to provide an overview of Form B, C, and D filings including best practices to consider when completing the forms. Since 2020, Michael Anderson has worked for the NDOI as an attorney. Chris Amory has been with the NDOI for 15 years and Jill Gleason, has 16 years with the NDOI.

How to Work With Your Regulators: Reporting, Ethics, and Confidentiality

For a one-hour ethics training, the NDOI will break down how insurers, agents, and their compliance attorneys can interact with their state regulators. They will also discuss a company’s and agent’s obligations of reporting, documentation, avoiding potential civil liability, and other issues.

On July 6, NDOI’s Legal Counsel Michael Anderson and Megan VanAusdall will host a class covering the ethical obligations of insurers and their attorneys under Nebraska Law. Michael Anderson, previously served as Assistant Attorney General in Missouri’s Medicaid Fraud Control Unit. Megan VanAusdall previously served as Legal Counsel with the Missouri Department of Insurance.

Pharmacy Benefit Manager 101: Nebraska Licensure and Regulation 

On Wednesday, Nov. 8, NDOI Counsel Cheryl Wolff will lead attendees in a training about PBMs. This training will give a basic overview of PBMs' roles in the pharmacy supply chain and explain Nebraska's Pharmacy Benefit Manager Licensing and Regulation Act. It will address topics including who must obtain a PBM license, penalities, and interaction with other state insurance laws. 

Before becoming an attorney with the NDOI, Cheryl served as a Senior Policy Advisor in the Governor's Policy Research Office for 14 years.
